The agreement
These terms are a contract between you and ClippingSpace ("we", "us") covering your use of clippingspace.tech and everything on it. By creating an account or using the service you accept them. If you do not accept them, do not use the service.
Our privacy policy forms part of this agreement and explains how we handle your data.
What the service does
ClippingSpace takes a video you supply, whether by link or upload, transcribes it, selects moments from it, renders those moments as short clips in the formats you choose, adds captions, and, if you connect an account, publishes those clips for you.
Clip selection is automated and works on signals like speech density, audio energy and topical completeness. It is a good starting point, not an editorial judgement. You are responsible for reviewing a clip before it goes out under your name.
Your account
- You must be at least 16 years old, or older if your country requires it, and you must give accurate registration details.
- You are responsible for what happens under your account, including keeping your password to yourself. Tell us promptly at support@platechecks.com if you think it has been compromised.
- One person or organisation per account. Do not share credentials or resell access.
- You can close your account at any time. See Delete your data for what that removes.
Plans and billing
- The free plan is genuinely free and needs no card. Paid plans are billed in advance, monthly or yearly, at the prices shown on the pricing page.
- Plans are measured in source minutes, which is the length of the video you import, not the number of clips it produces. Limits reset each billing period and unused minutes do not carry over.
- You can cancel at any time. Cancellation stops the next renewal and your plan runs to the end of the period you already paid for. We do not give pro-rata refunds for a period already started, except where the law gives you a refund right or where we have failed to provide the service.
- We may change prices with at least 30 days' notice by email. A price change never applies to a period you have already paid for.
- Prices exclude any tax that applies in your country unless stated otherwise.
Your content and rights
You keep ownership. Your source video, your transcripts and the clips ClippingSpace renders from them remain yours. We claim no ownership of them and no right to publish, license or reuse them.
The licence you give us is limited to running the service: permission to store, copy, transcode, transcribe, analyse and display your content in order to produce clips for you, to serve them back to you, to serve any share link you create, and to upload them to accounts you connect. It lasts as long as you keep the content on ClippingSpace and ends when you delete it. We do not use your content to train machine learning models.
You promise that you own or are licensed to use everything you import, that you have any permission needed from people appearing or speaking in it, and that publishing clips of it breaks no law and no third-party right.
If you believe content on ClippingSpace infringes your copyright, email support@platechecks.com with the work concerned, where it appears, and your contact details. We remove infringing material and terminate repeat infringers.
Acceptable use
Do not use ClippingSpace to:
- process or publish content you do not have the rights to, or content that infringes anyone's intellectual property, privacy or publicity rights;
- create or spread material that is unlawful, defamatory, harassing, hateful, sexually exploitative, or that depicts a real person doing or saying something they did not do or say;
- publish spam, bulk near-identical uploads, or anything designed to game a platform's recommendation system;
- break the terms of any platform you connect, or use ClippingSpace to work around a restriction that platform has placed on you;
- probe, overload or interfere with the service, circumvent plan limits, scrape it, or access it by any means other than the interfaces we provide;
- resell or white-label the service without our written agreement.
We may remove content and suspend accounts that break these rules. Where the breach is not serious and can be fixed, we will normally tell you first.
Connected platforms
Connecting an account such as a YouTube channel is optional. When you connect one:
- You authorise us to publish on your behalf, but only the clips you chose, at the times you set, with the settings you picked.
- That platform's own terms continue to apply to you and take precedence over ours for anything happening on their service.
- Platforms change their APIs, quotas and rules without asking us. A feature can stop working, or a publish can be refused, for reasons entirely outside our control. We will tell you when a publish fails, but we cannot guarantee delivery.
- Publishing is attempted at most once. A publish that may have partly succeeded is reported as failed rather than retried automatically, because a blind retry risks a duplicate post on your real account. You can retry it yourself.
- You can disconnect at any time, which ends our access immediately.
YouTube terms
ClippingSpace uses YouTube API Services. By using the YouTube features you also agree to be bound by the YouTube Terms of Service (https://www.youtube.com/t/terms). Google's handling of your information is governed by the Google Privacy Policy (https://policies.google.com/privacy).
You can revoke ClippingSpace's access to your YouTube data at any time from https://myaccount.google.com/permissions, or by disconnecting the channel in Settings. What we request, store and delete is set out in full on How we use YouTube API Services.
Our intellectual property
The ClippingSpace software, design, brand and documentation are ours and stay ours. These terms give you a personal, non-exclusive, non-transferable right to use the service while your account is in good standing, and nothing more. Do not copy, decompile or create derivative works from the service except where the law says you may despite this clause.
Feedback you send us is welcome and we may act on it freely, without obligation or payment.
Availability and changes
We aim to keep ClippingSpace available and fast, but we do not promise uninterrupted service. Maintenance, provider outages and platform changes all cause downtime. We may add, change or remove features. If we remove something significant that you rely on, or make a change that materially harms you on a paid plan, we will give reasonable notice and you may cancel for a refund of the unused part of your period.
Suspension and termination
You may stop using the service and delete your account at any time. We may suspend or terminate an account that breaks these terms, that is used unlawfully, that puts the service or other users at risk, or where we must do so by law. Where we can, we will give notice and a chance to put it right.
On termination your right to use the service ends and your content is deleted on the timetable in the privacy policy. Download anything you want to keep before you close the account. Clauses that by their nature should survive (your content warranties, our intellectual property, disclaimers, liability, indemnity and governing law) survive termination.
Disclaimers
The service is provided "as is" and "as available". To the fullest extent the law allows, we exclude all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that clip selection, transcription, captions or speaker tracking will be accurate, that a publish will succeed, or that the service will meet your requirements.
Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, your statutory rights are unaffected by this agreement.
Limitation of liability
To the fullest extent the law allows, neither party is liable for indirect or consequential loss, loss of profit, revenue, goodwill, or loss or corruption of data, however caused.
Our total liability to you for all claims arising in any 12 month period is limited to the greater of the amount you paid us in that period and one hundred pounds sterling.
In particular, we are not liable for a strike, takedown, demonetisation or account action taken against you by a platform you connected, or for content you published that you did not have the rights to.
Indemnity
You will indemnify us against claims, losses and reasonable costs arising from content you imported, processed or published through ClippingSpacewithout the necessary rights, or from your breach of these terms or of any law. This does not apply to the extent the claim arises from our own breach or negligence.
General
- Governing law. These terms are governed by the law of England and Wales, and its courts have exclusive jurisdiction. If you are a consumer, you keep the protection of the mandatory law of your own country and may bring proceedings there.
- Changes to these terms. We will post an updated version with a new date at the top, and give at least 30 days' notice by email of a material change. Continuing to use the service after a change takes effect means you accept it; if you do not, cancel before then.
- Assignment. You may not assign this agreement without our consent. We may assign it to a successor of the business.
- Severance. If a clause is unenforceable, the rest stands.
- No waiver. Not enforcing a right once does not waive it.
- Entire agreement. These terms and the privacy policy are the whole agreement between us on this subject.
- Third parties. Nobody other than you and us has any right to enforce these terms.
